1. Overview

Welcome to TherapyTrack ("we," "us," or "our"), a product of BWH99 LLC. TherapyTrack is a digital journaling and mental health tracking application designed to help users organize, reflect on, and access their personal mental health insights.

By using TherapyTrack, you agree to these Terms of Use ("Terms"). If you do not agree, you may not use the App.

2. Important Medical Disclaimer

TherapyTrack is not a healthcare provider.

• The App does not provide therapy, medical advice, or diagnosis
• The App does not replace a licensed mental health professional
• Use of the App does not establish a therapist-client relationship

If you are experiencing a crisis:

• Contact the 988 Suicide & Crisis Lifeline by calling or texting 988

3. Eligibility

You must be 18 years of age or older to use TherapyTrack. By using the App, you confirm that you meet this age requirement. If you do not meet this requirement, you may not use the App.

4. Description of Services

TherapyTrack provides tools including:

• Journaling and session reflections
• Mood tracking (morning, afternoon, and evening)
• Assignments and resource tracking
• Searchable entries
• Mental health assessments (non-diagnostic)
• Medication tracking

These tools are for personal use only.

5. No Provider Access

• TherapyTrack is a private, user-controlled tool
• Providers (therapists, coaches, etc.) do not have access to your account or data
• Any sharing (e.g., email exports) is user-initiated and user-controlled

6. Assessments Disclaimer

All assessments within TherapyTrack:

• Are educational only
• Are not diagnostic tools
• Should not replace professional evaluation

7. User Accounts

You agree to:

• Provide accurate information when creating your account
• Keep your login credentials secure
• Be responsible for all activity under your account

We may suspend or terminate accounts for misuse or violation of these Terms.

8. User Content

You retain ownership of all content you create in the App, including journal entries, mood logs, and notes. You grant BWH99 LLC a limited license to store and process this data solely to operate and improve the App.

9. Data & Demographics Use

We may collect non-sensitive demographic data (such as age range and general usage patterns) to:

• Improve the App and user experience
• Support marketing and outreach efforts

We do not sell identifiable personal mental health data.

10. Subscription & Payments

• Payments are processed via Apple App Store or Google Play
• Subscriptions renew automatically unless canceled before the renewal date
• Pricing is displayed clearly before purchase

11. Refund Policy

TherapyTrack does not issue refunds directly. Refund requests must be submitted through the platform where you made your purchase:

• Apple: reportaproblem.apple.com
• Google: support.google.com/googleplay

Refund decisions are made by the platform provider.

12. Cancellation

You may cancel your subscription at any time via your device settings:

• iOS: Settings → Subscriptions
• Android: Google Play → Subscriptions

Cancellation stops future billing but does not entitle you to a refund for the current billing period.

13. Acceptable Use

You agree not to:

• Use the App for any unlawful purpose
• Attempt to hack, disrupt, or reverse-engineer the App
• Upload harmful, illegal, or offensive content

14. Intellectual Property

All TherapyTrack content, features, and functionality (excluding user-generated content) are owned by BWH99 LLC and are protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works without our express written permission.

15. AI Features Disclaimer

TherapyTrack may include AI-powered features. Please be aware:

• AI is not therapy or medical advice
• AI outputs may be inaccurate or incomplete
• Do not rely on AI features for diagnosis or crisis support

AI features are support tools only and are not a substitute for professional care.

16. HIPAA & Data Classification Disclaimer

BWH99 LLC and TherapyTrack are not HIPAA-covered entities and do not function as healthcare providers.

• The App is a self-guided personal tool, not a clinical system
• Information entered may include personal reflections, but the App is not intended for storing protected health information (PHI) under HIPAA

Users are responsible for how they choose to use the App.

17. Limitation of Liability

To the fullest extent permitted by law, BWH99 LLC is not liable for:

• Mental health outcomes arising from use of the App
• Decisions made based on App content or features
• Data loss or technical failures
• Indirect, incidental, or consequential damages

Use of the App is at your own risk.

18. No Guarantee of Outcomes

BWH99 LLC does not guarantee any specific mental health, therapeutic, or personal outcomes from use of TherapyTrack.

19. Termination

We reserve the right to suspend or terminate your access to the App at any time for violations of these Terms or for any other reason at our discretion.

20. Apple & Google Compliance

• Apple and Google are not responsible for the App or its content
• They are third-party beneficiaries of these Terms
• Your use of the App must comply with the applicable platform's terms and policies

21. Dispute Resolution

Any disputes arising out of or relating to these Terms or your use of the App shall be resolved through good-faith negotiation first. If unresolved, disputes shall be submitted to binding arbitration or the appropriate courts located in the State of New York, and you consent to personal jurisdiction in New York.

22. Changes to Terms

BWH99 LLC may update these Terms from time to time. We will notify users of material changes through the App. Continued use of the App after changes constitutes acceptance of the updated Terms.

23. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of New York, without regard to its conflict of law provisions.
